Buy Here Pay Here Questions: Am I required to disclose the installation of a GPS unit on a vehicle I sell?

I was recently asked this question, and I wasn’t sure how to respond, so I decided to do a little research into the topic. Here’s what I’ve found: while many states do not specifically require the disclosure of GPS units on used vehicles, BHPH dealers who do not disclose them to the customer still run the risk of a lawsuit, brought against them either by the state or disgruntled customers. Each state has very broad legal catchalls in place, commonly known as “UDAP” laws; these cover unfair and deceptive acts and practices. It may very well be in your best interest to avoid any possible violations, and simply follow the practice of fully disclosing the use of GPS units on your vehicles.


Since the laws differ from state to state, when you’re in doubt, read up on your state’s laws, check with your lawyer, or your state’s independent dealer association.
